377 या गे सेक्स

भारतीय समाज को और अधिक मानवीय बनाने की दिशा में आपका शानदार प्रयास मीडिया गेम में कहीं खो गया है। नहीं, मीडिया परीक्षण मे नहीं,  इस बार यह 495-पेज का  फैसला  मीडिया के  बुद्धिमान प्रतिपादन द्वारा  लिंग तटस्थता (gender neutrality ) के संकट से जूझ रहा है ।


जैसे ही पता चला की ऐतिहासिक फैसला आ चुका है मैने गूगल पर 377 चिपका  पढ़नाचाहा की क्या फैसला आया । जैसे ही न्यूज़ का फ़िल्टर डाला  एक नयी दुनिया मेरे सामने आगाई। LGBTQ कम्यूनिटी के साथ हुये न्याए-अन्याये की अपेक्षा से कोई नयी न्यूज़ मिलने की आशा थी जो एक अजीब सी असमंजस मे बदल गयी।

मुझे लगा क्या भारत के 5 गुणी एवं  विचारशील न्यायाधीशों ने एक तरफा फैसला दे पुरुषों मात्र पर एहसान करा है और महिलाओ की उपेक्षा कर दी । ऐसा सोचने का कारण था की गूगल ने जितनी न्यूज़ मुझे दिखाई उसमे सिर्फ कुछ ऐसा पढ़ने को मिला :

ये कुछ प्रमुख पोर्टल्स हैं जो गूगल मे सबसे ऊपर आते हैं और जाने माने हैं । मैंने सिर्फ कुछ पोर्टल्स से  न्यूज़ हैड्लाइन्स को यहाँ लिखा है, ऐसे अनगिनत हैं । और जो अन्य थोड़े कमतर हैं उन्होने ने दया कर हैड्लाइन्स मे न लिख कर लेख मे अंदर ये कृत्य बखूबी करा है। 

इन सभी को पढ़ने  के बाद मैंने सोचा क्या अंग्रेज़ जो कानून बना कर गए थे वो भी क्या सिर्फ पुरुषों पर कुपित थे? इसलिए  मुझे अच्छी ख़ासी मेहनत कर IPC खोल भारतिय दंड संहिता के सेक्शन 377 को पढ़ना पड़ा  परंतु संहिता मे तो मुझे कुछ भी ऐसा नहीं मिला जो ये सोचने पर मजबूर करे की अंग्रेज़ सिर्फ पुरुषों पर कुपित थे  वहाँ तो  कुछ ऐसा लिखा था  --

"जो भी कोई किसी पुरुष, स्त्री या जीवजन्तु के साथ प्रकॄति की व्यवस्था के विरुद्ध स्वेच्छा पूर्वक संभोग करेगा तो उसे आजीवन कारावास या किसी एक अवधि के लिए कारावास जिसे दस वर्ष तक बढ़ाया जा सकता है से दण्डित किया जाएगा और साथ ही वह आर्थिक दण्ड के लिए भी उत्तरदायी होगा।"

अब सवाल ये उठा की  मीडिया को ये दैविक ज्ञान कहाँ से प्राप्त हुआ ? शायद पुरानी आदत है पुरुषों के प्रति पूर्वाग्रह के कारण  विकृति से उनको नवाजने की । अब पुरुष तो सदा नवाजा गया है की वह कामी, अत्याचारी, स्त्री हंता है इसीलिए शायद सेक्स के मामले मे भी इस तरह का सम्बोधन लाज़मी है। रही सही  कसर निर्णय आने से पहले रिलीस हुयी फिल्म "स्त्री " मे अमर कौशिक  ने पूरी कर दी।  मीडिया को लगता सारी प्रेरणा पुरुषों को निर्वस्त्र करने की यही से मिली होगी। वैसे कोई फरक नहीं पड़ता बस मुझे डर सिर्फ इस बात का है की इस तरह की न्यूज़ पढ़कर  कहीं शबाना आज़मी जी, नन्दिता दास जी और दीपा मेहता जी  को कहीं "आग " न लग जाए !   

फिर मेरे मन मे आया की कहीं संविधान पीठ ने ही तो नहीं ऐसा कुछ लिख दिया,  पर नहीं वहाँ भी निराशा हाथ लगी। मीडिया  की दिव्य ज्ञान शक्ति का स्त्रोत वहाँ भी नहीं मिला! मेरा लेकिन काफी ज्ञानवर्धन तब तक हो चुका था। आपके ज्ञान वर्धन के लिए ये जाना ज़रूरी है की "गे सेक्स" शब्द का प्रयोग पूरे निर्णय मे मात्र एक बार अनुच्छेद 82 मे किया गया है । पर न्यूज़ पोर्टल्स पर पढ़  कर ऐसा लग रहा मानो ये सिर्फ पुरुषों के लिए ही निर्णय आया है और महिलाएँ इस संबंध मे कहीं कोई दखल नहीं रखती हैं। वैसे  निर्णय मे 133 बार गे शब्द का इस्तेमाल हुआ है और मात्र 82 बार लेसबियन शब्द का प्रयोग हुआ ।

अब क्या संविधान पीठ के इस निर्णय को आधार बनाकर  ये मान लिया जाये की भारत मे महिलाओं का इस तरफ रुझान पुरुषों से  आधा है और इसलिए ही मीडिया ने सिर्फ गे सेक्स को प्राथमिकता दी?  ये तो सरासर अन्याये है पुरुषों और महिलाओ दोनों के प्रति। मेरे हिसाब से ये शोध और अन्वेषण का विषय है और महिलाये पुरुषों से कंधे से कंधा मिलकर इसमे भी बराबरी ज़रूर करेंगी।

मीडिया चाहे जो समझे पर मुझे सबसे ज्यादा खुशी इस बात की हुयी की 5  न्यायाधीशों की खंडपीठ मे 4 पुरुष न्यायाधीशों  के अतिरिक्त एक महिला आदरणीय  इंदु मल्होत्रा जी भी इस बेंच में शामिल हैं और यह एक गर्व का विषय है  की 495 पृष्ठों का निर्णय लिखा भी एक महिला  द्वारा  ही  लिखा गया  है । 

मुझ मे न्यायतंत्र जितना  ज्ञान और रुतबा तो नहीं पर पुरुषों की मीडिया से हुयी प्रतारणा से मेरे मन मे  उपजे संवेग लिखना ज़रूर बनता और इसलिए भी ज़रूरी है कि कहीं  दुखी हो मन बहलाने के लिए पुरुष कोई "अन्य" सहारा न ढूंढने लगें:

पुरुष बना अब आदत , बार बार तुझे सब  ने घेरा 

घाघरा अगर पहन लेता तो न होता इतना अंधेरा !

Have you seen men on the ramp? "Yes many times".  But wearing bikinis. "No never". These answers are quite obvious as men have much to hide and exposure is not a manly thing. Then what is manly? Simple, to take pains and learn not to cry!

The irony, paradox, or a dilemma, no nothing from these,  it is a stark reality that men must not expose any wound of theirs for it is a feline act. As a male commodity, the permission is given to fag and gag but never tag yourself as a human breathing when there are lady lungs inhaling much of liquid Oxygen that impartially flows under armpits of every civilized organism.

"I am  odorless when as I am in a public show, including my armpit.", believes every man. Don't you do as well as being a man?  Armpit, yes the same place that is found adjacent to the breasts. Men don't have breasts but they do suffer from breast cancer. It is difficult to believe because theirs have no lingerie connection, but they need to be covered as well, unlike any other emotion that equally exists behind those breasts but is taught to avoid exposure. Why? Simply because men are men!

Leave apart the internalized pains, let's be little physical here. The medical fraternity has established that men feel more pain after surgeries than women. Indian men, no no, it is a phenomenon with men all over the world. The Euroanaesthesia research established pain experience in gender differences where men scored more. Not a sexist comment but men are superior in this regard as well. So they can be a better commodity then women.

Men are indeed a commodity, they can't comfort surrogacy but they have to be productive. They cannot breastfeed but have to arrange fodder perpetually. They can't be sold but bear transactions where every existence of a man can be put to stake. I remember that old Bollywood song Dulha Bikta Hai by Gauhar Kanpuri, which was nothing but a foretelling of a future of men where will lie an agenda of new business that will enslave the hairy population of the world. Earlier the song was a mere balance of convenience to give the free version of an anti-virus, the taster of women oppression, that in the new millennium will become a spyware in itself, the agenda of using men perpetually.

Strangely, modern women love to be called a sex commodity, for that relates to their natural ability and make. But do men enjoy the same way? I guess they do not because firstly they have no related material to be put on sale or display nor the free will to do so. All is so well arranged by the society. A man is so viciously committed to one home, one ideal, as one commodity.

Whatever may be preached, but it is noteworthy that commodity is a nebulous word. Commerce is not what can be the father of it when a "soft commodity", the man, is taken into consideration. It is not the “human commodification” that is to be understood as a meaning but rather a livestock. This livestock is again not for animal husbandry because a man shares the term husband, hence this exclusively means a lovelock or precisely a lovestock-- Keep it, stock it, rear it and use it.  Congratulations, I have diversified the meaning of the word commodity and the social scientists can find greener grass to graze upon.

People believe that it is a common idea to talk against women because male chauvinism is widespread and women are historically oppressed. I guess it is a fact because Gynocentricism can be a myth but Hypergamy is indeed a truth,  and man anyhow needs to maintain his hypergamous status till alive.  Androcentric views are insulting in the liberal markets where men are not seen as a commodity but rather an item that is distributed at free will of the society and strangely this all emanates from the exceptional ability of a man to be flexibly used.

Here I am reminded of the works of Karl Marx, who seems to have totally wasted his skills in enriching the world about abilities of men, and the rule of demand and supply. Once a machine itself becomes a commodity it is destined to be so, work hard and die young, none cares. Male powerlessness has given rise to a need for studies to be made on the Male Responsibility Quotient and the variables and parameters to be used must include disposability, endurance, impuissance, and vulnerability. The results then should be studied with respect to the nature of salability and the units of resistant to pain. Man will be a perfect subject of research, as he has universally developed a  potential to balance between survival and fulfillment.

I am sure all this will provide quantified results where a man can officially be declared to be sold. I am waiting to see Amazon putting a "shop by category" where there will be choices to get men with all qualities based on the responsibility quotient and a "do not complain" fantastic male commodity with full marital compatibility. (Read it carefully it is not martial it is marital !) And yes with the bonus offer, "buy one get one free", not for adultery but as after sales service, a matter of replaceable guarantee in case dispute arises. After all material world has little need for emotions and ethics, but more of a perpetual source of pleasure, comfort, money, and germs.

Contempt : It is only a man who can do it.

It is mischievous to write upon issues other than those of "weemen" on the "International Women's Day". I am doubtful if I am guilty of the crime for it is almost nearing to the sunset and I feel I can claim for an immunity from a contemptuous behaviour against claimed 50% of the population of the world. It is no more a day, hence a partial compliance, or let`s say no locus standi. 

You should not be surprised of me using the word "weemen" instead of women as I am a man and Contempt is in my nature. Though lexically it is very ironic and entails an "aroma of weed and semen mixed". Now see,  after reading it, don't you feel putting me on a trial under The Contempt of Courts Act, 1971. Sure you can, but my next question would be under whom? A lady judge or a male one? There will be impartial comments for not being able to allow partiality if tried by a male judge, hence I prefer to be thrown at the mercy of a lady judge. Before I get doomed "unheard", I must give some of my literal bacteria to this infected world with the cathartic idea of women empowerment.

Sounds a cliche to me but it is a mode of earning too many, the women empowerment is seen either in a typical Indian house or in the Indian Family Courts (FC's). Both are identical where ladies rule. The FC's have a tremendous transforming power of converting a man into a "man-hater man". It is not a hyperbole but a reality found in the court records where male judges are seen convicting husbands. Why? That's no question for they must have committed a crime. Family Courts do convict, at least the men.

This is not what surprises me as the conviction of men is quite common in India like that of their suicide. My astonishment is regarding my experience with the lady judges in the FC's.

Recently, I happen to witness a lawyer filing a Contempt petition in the High Court against a Lady Judge in the Family Court and informing her about the same. What followed was a series of disrespect for that exceptionally meritorious, learned and a committed lawyer towards fine-tuned advocacy. Despite, he is an iconoclast and a trendsetter, he faced scorn from his fellows for doing a heinous job as Contempt is made to be a destined word for men. All this Kolaveri, a chaos because that lady judge was a female. Now he is under threat, both from the judge and the colleagues. But he continues to dare to be a gentleman, and will never discontinue discarding "weemen" until the gender equality is found to be a leading ground for judgments.

The court is adjourned, I am still safe, maybe next time. Till then let's take a date and go on a date, but again the question will with whom? A Lady but of course!
